Lindsay Lohan's GTA 5 Lawsuit Has Been Rejected Again

Actress Lindsay Lohan's attempt to have the makers of Grand Theft Auto held liable for violating her privacy fizzled in New York's top court.

CNet reports that the New York State court of appeals rejected Lohan's appeal of her loss in the lawsuit, in which Lohan claimed the company appropriated her image for a character in the game. The question came down to whether Lacey Jones, which was also heavily featured on promotional materials the box and disc art for the game, could be considered a portrait of Lohan. The New York Appeals Court is the highest in the state, so the lawsuit can't be escalated further up the chain.

Lacey Jonas is a one-off character appearing in a random event called "Escape Paparazzi" in Grand Theft Auto 5.

This was the other character Lohan was upset with. The court said that Lacey may constitute a "portrait" under NY civil rights law but that the artistic rendering was "satirical" and "not reasonably identifiable". Lohan brought her case against Take-Two in 2014.

The Grand Theft Auto franchise has almost always used a good looking, scantily clad, suggestive cartoon women in their promotional material or for loading scenes.

Neither Lohan's spokesman, her lawyer, nor Take-Two commented on the decision. "But when they asked me to be their spokesperson, I was intrigued".

In 2010, she settled a $100 million lawsuit against E-Trade over a Super Bowl commercial featuring a "milkaholic" baby named Lindsay, an ad the actress felt was mocking her various drug and alcohol arrests.

It is unclear if Lohan will continue to pursue the case, but given her lawyers' seemingly undying dedication to this cause, we'll likely hear about it again soon enough. Pitbull's lyrics stated: "So, I'm tip-toein', to keep flowin', I got it locked up, like Lindsay Lohan", and Lohan was not able to win her cases against the conservative news network or the entertainer.
