Judge Halts Deportation of Pizza Delivery Man-For Now

Elected officials joined Villavicencio's wife and two young daughters for the press conference outside Fort Hamilton on Wednesday, slamming the delivery man's detention.

The reprieve means Villavicencio, who is married to a USA citizen and has two young children, will remain at an Immigration and Customs Enforcement detention facility in the US until his case is adjudicated. New York Sen. Kirsten Gillibrand called the incident "shameful", and said the Trump administration's immigration policies are "inhumane, plain and simple" and do "not make our country safer".

"We urge ICE to grant the stay on humanitarian grounds as he pursues other avenues through his USA citizen spouse", said Jennifer Williams, deputy attorney in charge of the immigration law unit at Legal Aid Society. "Further, his expedited removal will cause significant harm to his US citizen wife and two young children who depend on Pablo for financial and emotional support". Another person close to the case, who asked not to be identified, added, "I have no idea what the governor is talking about".

Villavicencio would also need to have only crossed the border illegally once, as multiple crossings make it nearly impossible to get a spousal green card.

Chica is an American citizen and married Villavicencio - who is from Ecuador - five years ago. An ICE spokeswoman said he was "illegally present" in the country after he had been granted voluntary departure by an immigration judge in March 2010.

He had been to the base several times before, presenting his NY city ID card that carries no mention of his immigration status. "We ask ICE to release him and let him come back to us".

Steven Choi, executive director of the New York Immigration Coalition, called it "absolutely disgusting".

Immigration and Customs Enforcement officials said the military police officers at the base then detained Villavicencio and turned him over to federal immigration officials. "I'm listening", Councilman Justin Brannan (D-Brooklyn) said.

When he arrived at Fort Hamilton, guards requested identification and he produced a city identification card.
