Megaupload's Kim Dotcom loses bid to avoid US extradition

Mr Dotcom and his co-accused have consistently denied the United States charges.

Andrew Little, New Zealand's justice minister, will now decide whether the extradition to the USA will go ahead following a final appeal by Mr Dotcom.

He disputed the court's interpretation of copyright provisions.

Dotcom enjoyed early successes in his legal battle, extracting an apology from then prime minister John Key when it emerged New Zealand intelligence services illegally spied on him.

In his July 5 media statement, Dotcom continued: "To say that I am extremely disappointed by the decision of the Court of Appeal today is an understatement".

Dotcom said his legal team are confident the Supreme Court will hear the appeal given there are such significant legal issues at stake. "The court has confirmed all of these extradition pathways are available to the United States", a summary of the judgement said.

The German-born tech mogul this year asked the New Zealand Court of Appeal to overturn a decision approving his extradition but his request was on Thursday morning turned down. Many importance cases in New Zealand are not won in the Court Of Appeal, or in the courts below, but are won when they reach the Supreme Court.

The group had lost their case in the North Shore District Court in 2015 and now subsequent appeals to the High Court and the Court of Appeal.

They deny the accusations and have been fighting hard against extradition, arguing that Megaupload was simply a file-sharing website and that they shouldn't be blamed for what others were uploading to it. "We will seek review with the NZ supreme court".

"An extradition hearing is not a trial". This new ruling - which still isn't a ruling on guilt - states that the fraud aspect does qualify them for extradition and that the U.S. court should get to see him in the ample flesh for a hearing.
