Delhi gangrape case: SC to deliver verdict on convicts pleas tomorrow

Howard TerryJul 09, 2018

The Supreme Court is set to pronounce its judgement in the Review petitions filed by the convicts in 2012 Nirbhaya rape case, on July 9. Following which, the three convicts appealed before the Supreme Court for review its order of death sentence.

Interestingly, the committee was opposed to the death penalty as a punishment - even in the rarest of the rare cases.

The Apex Court had on May 4, this year, reserved its order on the review petitions filed by the convicts - - Pawan Gupta (31), Vinay Sharma (25), and Mukesh (31) - - in the case also referred to as Nirbhaya gang-rape and murder case.

AP Singh, the lawyer for the convicts told ANI, "The sentence was upheld due to public and political pressure".

Justice Ashok Bhushan delivered the judgement for the Bench of Chief Justice of India Dipak Misra, Justice R. Banumathi and Justice Bhushan. They can file one last petition with the Supreme Court, and if it's again rejected, they can seek presidential mercy, said A.P. Singh, the defence attorney.

Their daughter - a physical therapy student who became known as "Nirbhaya" which means "fearless" - had gone to see the "Life of Pi" with a male friend at a popular New Delhi mall cineplex on the night of December 16, 2012 when they boarded a private bus to make their way home to a neighborhood on the outskirts of India's capital city.

In the December 2012 attack, prosecutors said the four took their victim to the back of a private bus in New Delhi, raping her and then damaging her internal organs with an iron rod. The accused are bus driver Ram Singh, his brother Mukesh, assistant gym instructor Vinay Sharma and fruit-seller Pawan Gupta.

The case also put the treatment of women in the world's largest democracy in the global spotlight and led to a stiffening of sentences for sex crimes. One suspect, Ram Singh, was found dead in jail in March 2013, having apparently taken his own life.

Four of the six men who raped and tortured a 23-year-old paramedic student have appealed against the death penalty. The youngest accused, just days short of 18 when he committed the crime, was sent to juvenile home.

The woman succumbed to her injuries in a Singapore hospital on December 29 the same year. He was awarded 3 years of sentence in a special home.
