George W. Bush Praises Nomination of Kavanaugh for Supreme Court: ‘Outstanding Decision’

Lynette PayneJul 11, 2018

President Trump nominates Judge Brett Kavanaugh to the Supreme Court during an event in the East Room of the White House in Washington on July 9, 2018.

The Trump 2016 campaign is under criminal investigation by Special Counsel Robert Mueller on suspicion of collusion with the Russian government to influence the result of the presidential election.

"He is a committed textualist and originalist, one whose time on the bench has revealed a unique ability to apply these principles to legal facts", J.D. Vance - the conservative author of the bestseller Hillbilly Elegy and a student of Kavanaugh's at Yale Law School - wrote in the Wall Street Journal. This nominee was hand-picked by anti-LGBTQ, anti-choice groups in an explicit effort to undermine equality - and the prospect of a Justice Kavanaugh threatens to erode our nation's civil rights laws, block transgender troops from bravely serving this nation and allow a license to discriminate against LGBTQ people in every aspect of American life.

Kavanaugh now serves as a judge on the U.S. Court of Appeals for the District of Columbia Circuit. As a young attorney in prosecutor Kenneth Starr's office, he was the lead author of the salacious Starr Report calling for president Bill Clinton's impeachment, and represented George W. Bush in the Florida vote recount that awarded the 2000 election to Bush.

Kavanaugh's selection was met with predictable reaction from both Republicans and Democrats.

Kennedy, who is 81, had been nominated for the court by President Ronald Reagan in 1987. "Brett is a brilliant jurist who has faithfully applied the Constitution and laws throughout his 12 years on the D.C. Circuit".

The conservative Judicial Crisis Network is set to launch a $1.4 million ad buy on behalf of President Donald Trump's Supreme Court nominee.

Jones was among the Democratic lawmakers invited to the announcement at the White House but did not attend.

"My judicial philosophy is straightforward", he said.

A handful of Senate Democrats running for re-election in states that Trump won handily in 2016 could face a hard vote on the court nominee, potentially providing Republicans with an additional buffer if they decide to support the president.

Trump published a similar list during the 2016 campaign, and it was widely credited with helping him win the votes of social conservatives who otherwise might have been skeptical of a thrice-married billionaire from NY.

In what is likely to be one of the most consequential decisions of his presidency, Trump selected Kavanaugh to replace retiring Justice Anthony Kennedy.

Senate Majority Leader Mitch McConnell, R-Ky., told Trump he believes Kethledge and Hardiman might be easier for the Senate to confirm than either Kavanaugh or Barrett, The New York times reported, citing Republican officials briefed on the conversations.

"Thrilled tonight with @realdonaldtrump's pick for the United States Supreme Court", Rogers posted on Twitter. "I am pleased to say that I have found, without doubt, such a person". He said that picking a new justice was the most important responsibility of his office other than matters of war.

The president has also been wooing red-state Democrats as a kind of insurance policy. Joe Manchin, a Democrat from West Virginia, which Trump won by 42 percentage points.

Mike Barnicle added that it would please Susan Collins and other wavering pro-life Republicans, former RNC chief Michael Steele said Kavanaugh's history as a former altar boy gave them an instant connection.

Sen. Susan Collins of ME is one of two Republican senators who support abortion rights and is facing pressure from the left to oppose Kavanaugh.

Trump has vowed to put justices on the court and overturn Roe v Wade.

The president said: "Judge Kavanaugh has impeccable credentials, unsurpassed qualifications and a proven commitment to equal justice under the law".

A nominee needs a majority of 51 votes but, as Senator John McCain is battling cancer in Arizona, Trump can now only muster 50 votes.

By keeping Scalia's seat open, McConnell gave Trump a head start in putting his own stamp on the high court, and the president acknowledged as much when Gorsuch was sworn in previous year.

"I'm getting very close to making a final decision", Trump told reporters as he left Morristown, N.J., on Sunday to return to the White House.

McConnell and Trump were rewarded this year with a string of 5-4 decisions in which Gorsuch cast votes favorable to the president and the GOP. By lowering the mandatory retirement age of judges to 65, Kaczynski aims to stack the court with party hacks and loyalists.

Although the kickoff of the battle for the court occurred with Trump's nomination, the lines of argument worked for all the court finalists.
