National Archives: We can't produce all Kavanaugh docs until end of October

Grassley says he will not ask the National Archives to release the documents from Kavanaugh's time as White House staff secretary because they are too sensitive.

The documents at issue, sought by Trump's fellow Republicans, relate to Kavanaugh's service from 2001 to 2003 as a White House lawyer under Republican former President George W. Bush.

"This unprecedented process appears to be designed intentionally by Republicans to deny the Senate and the American people the information they need to evaluate this critically important nomination", said Senate Minority Leader Chuck Schumer, according to NBC News.

The documents could be produced earlier via a separate source: the Bush presidential library, which is conducting its own review.

Republicans have been hesitant to request those records, however, and have accused Democrats of engaging in stalling tactics.

Democrats wrote to the National Archives requesting a broad set of the documents, using a letter with almost the same language that was sent by both parties in 2010 seeking documentation about Obama's nominee Elena Kagan.

"The committee will receive documents in an even more rapid fashion from the Bush Library as the Archives continues its statutory document review", spokesman Taylor Foy said in a statement.

"To help expedite the Committee's access to records, President Bush has expressed his willingness to make available directly to the Committee copies of records that the team of lawyers has reviewed and that he has approved for disclosure", Burck said in the letter to Schumer.

"It seems to me like early September would be the earliest" for hearings in the Senate Judiciary Committee, the panel's chairman Chuck Grassley told the Hugh Hewitt Show.

And even if one is concerned about this possibility, one solution would be to have the Archives folks review any documents the Bush team says should be withheld. "To be clear, President Bush has offered this as a courtesy to the Committee to assist in a timely assessment of Judge Kavanaugh's nomination".

Republicans hold a slim 51-49 Senate majority.

A delay in the confirmation process would give Democrats more time to hammer Kavanaugh, a conservative jurist they fear could swing the high court to the right for decades and imperil landmark cases like Roe v. Wade. The signing statement suggested that Bush could circumvent the law.

Republicans had hoped to confirm Kavanaugh in time for the opening of the Supreme Court's fall term on the first Monday in October.

Utah GOP Sen. Mike Lee argued that Kavanaugh's views were just "talking points" and "not the development of policy".
