Zanu PF Confident Chamisa Has No Case After Election Challenge

Howard TerryAug 11, 2018

The Nelson Chamisa led MDC Alliance has filed its papers challenging the presidential election results in which the Zimbabwe Electoral Commission (ZEC) declared the incumbent, Cde Emmerson Mnangagwa as the victor.

Justice Minister Ziyambi Ziyambi told Reuters Sunday's inauguration "will no longer happen" until the case is finalised.

The election, the first since the army's removal of 94-year-old ex-president Robert Mugabe last November, passed off relatively smoothly but its aftermath revealed the deep rifts in Zimbabwean society and the instinctive heavy-handedness of the security forces.

The Constitutional Court has 14 days to decide on the matter.

Some of the lawyers who filed the papers for Chamisa include, Chris Mhike, Douglas Coltart, Advocate Thabani Mpofu, Advocate Dali Mpofu and Advocate Sylvester Hashiti.

The party must prove any irregularities were widespread enough to change the outcome of the vote.

"We have a good case and cause!" he tweeted shortly after filing the challenge.

She said the United States Government is deeply concerned that Zambia chose to hand over Mr Biti to the Zimbabwean authorities, and in the face of a reported Zambian court order blocking his expulsion from Zambia.

European Union observers said that the ZANU-PF candidate had benefitted from an "un-level playing field" and some voter intimidation, though global monitors largely praised the conduct of the election.

Worldwide monitors largely praised the conduct of the election itself, although European Union observers said that Mnangagwa, a former ally of Mugabe, benefited from an "un-level playing field" and a degree of voter intimidation.

"We are seeking a declaration to the effect that the presidential election was not properly conducted".

"I am confident they have no case".

Analysts say the legal challenge has little chance of success given the courts' historic tilt towards the ZANU-PF, which has ruled since independence from British colonial rule in 1980.

"We call on Zimbabwe's leaders to guarantee Mr Biti's physical safety and ensure his constitutional and human rights are respected".

The move is in a bid to strengthen the revolutionary party.
