Supreme Court rejects net neutrality appeal

Aside from the DACA program, the youths have no legal right to remain in the country because they either entered illegally or over-stayed entry visas and thus became illegal residents. That still remains federal policy. Numerous young people have become fully integrated into their communities.

The appeals lingered mostly because the Trump administration sought repeated extensions of the deadline for filing the government's brief.

Jessica Rosenworcel, the Federal Communication Commission's only Democratic Commissioner, noted that the FCC had argued that because the Trump-era FCC had repealed the 2015 rules, the 2016 decision was moot and should be wiped from the books.

"Those decisions are wrong, and they warrant this court's immediate review", Francisco said Monday.

Under the Supreme Court's normal schedule, the justices will say in January whether they will take up the appeals.

The legality of the program is not at issue in the case.

Regardless, net neutrality supporters were encouraged by the Court's decision.

The Justice Department's move was unusually aggressive in terms of procedure, asking the justices to take action even before intermediate federal appeals courts have ruled on the three lower court rulings.

The Supreme Court on Monday declined to hear an appeal to the 2016 ruling. In the letter, Francisco told the justices that "prompt consideration" of the three cases is essential because nationwide injunctions require the administration to keep the program in place while the litigation challenging efforts to end it continues.

USTelecom downplayed the importance of the court ruling in a statement. That suit, which is also pending before the D.C. Circuit, is quickly becoming the center of the legal battle over net neutrality now, with the Supreme Court deciding not to hear its net neutrality case. "The ISPs went all out to push FCC Chairman Ajit Pai to repeal the agency's net neutrality rules - and then ran to the Supreme Court looking for a do-over on earlier cases that rightly upheld those rules". The trial judge refused to rule on that challenge, concluding that the states had waited too long to challenge the original DACA program.

That leaves the conservatives with a solid five-to-four majority in the high court, elevating the chance the Trump administration could win support for its stance on DACA.

This is not the first time the federal government has made this request. Those are the orders that the Administration has now asked the Justices to overturn.

The request comes after the Supreme Court rejected a similar plea in February. His work has appeared here since mid-2011.
